La gestion des biens des incapables

Abstract

La réforme du Code civil entreprise il y a déjà plusieurs années est sur le point d'être complétée. Cette réforme, tantôt bouleverse, tantôt réaménage le droit actuel, mais tend toujours à créer un ensemble de règles plus cohérentes et mieux adaptées à notre société. Le présent article expose un chapitre du Livre des biens, l'administration du bien d'autrui, dans l'une de ses applications: la gestion des biens des incapables. Après avoir établi le rattachement des régimes de protection des majeurs au chapitre de l'administration du bien d'autrui, l'auteur expose les règles communes de l'administration du bien d'autrui en intégrant les dispositions exceptionnelles ou complémentaires propres à la gestion des biens des incapables et en soulignant les modifications apportées par la réforme et les motifs qui les ont justifiées.

Abstract: The reform of the Civil Code begun several years ago is almost finished. In the reform, the existing law is in part radically changed, in part reorganized, but always with the intention of creating a more consistent set of rules more closely adapted to the society in which we live. This article deals with one title of the Book of Property, in one aspect of the administration of the property of others, namely the administration of the property of incompetent persons. After explaining that the protective supervision of persons of full age is linked with the administration of the property of others, the author sets out the common rules for administration of the property of others by integrating the provisions for exceptional cases and supplementary provisions applying to the administration of the property of incompetent persons and by noting the changes made in the reform and the reasons underlying those changes.
