Le corps humain, centre d'un conflit de valeurs : les dons d'organes et de tissus

Abstract

Résumé: Cet essai se veut une réflexion sur le statut juridique actuel des tissus humains par le biais de l'analyse de la problématique du don d'organes et de tissus humains examinée dans son contexte social et ses aspects techniques. La situation juridique de ces organes , et tissus humains eux-mêmes et des participants à ce don particulier est aussi étudiée à travers la jurisprudence et la doctrine répertoriées tant en common law qu'en droit civil. Finalement, les modes de disposition individuels et collectifs d'organes et de tissus humains et les propositions de changement à ces modes de disposition sont exposés.||Abstract: This essay examines the present day judicial status of human tissues as it applies to the donation of human organs and other tissues, and viewed in the light of the social context and technical aspects of organ and tissue donation. The judicial situation relating to the donation of human organs and tissues and to persons implicated in a particular donation is also studied with respect to the jurisprudence and doctrine as it appears in both common and civil law. Finally, the method of disposal of human organs and tissues, in both individual and collective donations, are examined in this study along with some proposals for changes to the present method.
