Le clonage humain reproductif : les écarts entre le droit, l'éthique et la science

Abstract

Résumé: L'évolution technologique est à son apogée; il est maintenant question de création d'êtres humains . A l' aube du clonage humain reproductif, nous tenterons de concilier le droit, l'éthique et la science . Tout d 'abord, nous analyserons l'aspect scientifique afin de bien saisir les enjeux reliés à l'utilisation des techniques de clonage. Une fois démystifiées, certaines obscurités effrayantes seront banalisées. Une approche bioéthique des problèmes permettra de solutionner certains conflits de valeurs a priori irréconciliables. Subsidiairement, nous analyserons le cadre juridique associé à cette nouvelle technologie de reproduction. Un sujet d'envergure tel le clonage humain nécessite des interventions internationales et nationales. Après un survol général, nous observerons la situation particulière du Québec concernant la légalité d'une telle pratique pour ensuite questionner les règles de responsabilité . Advenant l'efficience de la technique du clonage reproductif, le clone ainsi conçu aurait-il des recours contre ses «créateurs »?||Abstract:The evolution in technology is at its apogee; we are talking about creating hurnan beings. As we will soon be at the stage of human cloning, we need to reconcile law, ethics and science. First, we will analyse the scientific aspect so we can understand all the consequences related to the use of cloning techniques. By understanding the basics, some frightening uncertainties will be demystified . A bioethical approach will allow us to solve certain conflicts of values. We will then analyse the legal aspect associated with this new reproductive technology. A subject of such magnitude as human cloning requires international and national interventions . Following a general overview, we will examine the situation that is specific to Quebec with regard to the legality of such a practice to finally analyse the rules of liability. Should reproduction cloning become feasible, will the clone thus conceived have any recourse against its " creators" ?
