Les aspects juridiques de la pratique infirmière en pharmacie

Abstract

Résumé: Cet ouvrage se veut une analyse de la pratique privée de l'infirmière en pharmacie au Québec. Tout au long de cette étude, l'auteure explique le cadre actuel de l'exercice infirmier dans le contexte choisi, en explorant les questions et les exigences légales que soulève ce champ d 'activité professionnel. L'essai se divise en deux parties. La première se consacre à l'analyse du domaine infirmier en général, pour ensuite en étudier sa compatibilité avec la pratique de l'nfirmière en pharmacie. Deux thèmes sont étudiés plus particulièrement, soit: la possibilité pour une infirmière de poser des actes médicaux délégués hors établissement et la nécessité d'une révision par le législateur des domaines d'exclusivité pour préciser le chevauchement législatif de certaines professions et de ce fait, clarifier la pratique en pharmacie. La seconde partie se concentre sur les divers aspects de la pratique dans ce milieu en revisant l'ensemble des règles juridiques qui leur sont applicables. L'auteure termine en soulignant les problèmes de la pratique infirmière en pharmacie, en décrivant des solutions potentielles, leurs avantages et leurs faiblesses, pour finalement conclure de la pertinence d'adapter la situation juridique actuelle des infirmières à la pratique diversifiée des soins infirmiers notamment en pharmacie.||Abstract: This text is an analysis of nursing in private practice in drugstores of the province of Quebec. Throughow this study , the author explains the current state of nursing practice in the abovee-mentioned context and explores the legal questions and obligations that arise from this particular field of work. There are two parts to this essay. The first part starts with nursing practice in general and follows through with a study of how compatible are its rules and regulations With the particular context of work in a drugstore. Two points are detailed, the first is the possibility for the nurse to perform delegated medical acts outside of the usual institutional context and its legal impacts. The second is the need for clarification of the extent of domain exclusivity in the practice of certain professionals by the legislator with special attention to the current overlapping of responsibilities that occur in a pharmacy. The second part reviews the various aspects of nursing practice in drugstores by concentrating on th e legal rules of practice as they apply to this specific context. The author ends by highlighting the problems of nurses with regards to their practice, exploring the pros and cons of potential solutions and concludes by indicating that there is a need to adapt the current, institution-oriented legal framework to a more diversified and decentralized model of nursing that takes into account the new realities of modern practice, most notably in drugstore nursing.
