dc.description.abstract | Résumé: Nous nous interrogeons dans cette étude sur les facteurs qui peuvent influencer la présence de la médiation dans l'organisation en nous inspirant d'une analyse comparative entre la France et les États-Unis. Aux fins de notre travail, nous reproduisons cette analyse en comparant la société québécoise avec la France. Le modèle de référence utilisé provient de l'ouvrage d'Arnaud Stimec où il identifie les facteurs institutionnels globaux suivants : historique de la médiation dans les relations collectives, litige individuel du travail, incitation à négocier et médiation en relation de travail, rôle des gouvernements à travers les lois, le rôle du syndicat et le droit de grève qui est constitutionnel. Nous reprenons ces descriptions de la France et tentons de les reproduire au Québec afin d'en tracer un portrait.||Abstract: We question ourselves in this study on the variables that can enable the presence of the mediation in the organization. These variables are represented by global institutional factors of the society that were used to compare France and the United States. ln order to realise our study, we take these the same variables like evaluation's tools and try to apply them to the Québec society and then comparing them with France. The reference model used is based on the variables identified in the study realised by Arnaud Stimec, he identified the following variables: history of the mediation in the collective relations, individual litigation at work, incentive to negotiate and mediation in labour relation, role of the governments through the laws, the role of the trade union and the right to strike being constitutional. We take those descriptions made for France and try to reproduce for each of them the portrait of Quebec. The objective aims at knowing the current situation as well as the events that led to this situation for then submitting the results obtained · to the syllogism of the author. He provides an explanatory model which supposes that there is not one characteristic development dominating making it possible to explain the evolution of the mediation in a society. Thus, the mediation can be present in places without those experiencing the same development. ln conclusion , we evaluate the impact among them in order to lead to mediation and we will look at the future in order to see what we could be expected for the mediation as resolution conflict mode in the organization. | |
