La futilité médicale dans la relation thérapeutique entre un médecin et son patient

Abstract

La futilité des soins est une réalité avec laquelle les acteurs du système de santé doivent travailler et qui complexifie par moment la relation thérapeutique entre un médecin et son patient. Cet essai a pour objectif d’analyser cette problématique, alors qu’en premier lieu, nous allons explorer les différentes définitions que peut avoir la futilité d’un soin. Nous analyserons ensuite quels sont les droits et obligations du médecin, du patient et de ses proches dans un contexte où des soins futiles sont invoqués. Dans la deuxième partie, nous présenterons trois méthodes de résolution de conflit et nous suggérons, en nous basant sur l’expérience de certains États américains, le contenu d’une politique québécoise sur la futilité.

Abstract : Futility of care is a reality with which actors in the health system have to contend and which can at times complicate the therapeutic relationship between a doctor and his patient. This essay discusses this problem by exploring, in the first part, the various definitions of futility of care. It then examines the rights and duties of the physician as well as the rights of the patient and of his family in situations involving care deemed futile. In the second part, three methods generally utilized in the resolution of conflicts are examined and, based on the experience of some American states, a policy regarding futility of treatment and conflicts arising therefrom is proposed for Quebec.
